The travel industry and travelers have oft been
in the news of late; the most recent and most spectacular incident being that of the passenger dragged of a United Airlines aircraft and, according to reports, getting his nose broken and a couple of teeth knocked out in the process.

My, he must have been a nuisance. Imagine the temerity of the man thinking he could defy the airline’s over-booking policy. It is sad to reflect on the airline’s original advertising slogan: ‘Fly the friendly skies of United.’

If you are a lawyer, you are already aware that there is a rather vast and ever increasing body of law pertaining to the vicissitudes of travel and you will also be familiar with the definitive main legal text on the subject: ‘Saggerson on Travel Law and Litigation.’

The good news for the beleaguered travel lawyer coping with the dizzying pace of change in this area is that ‘Saggerson’ is now out in a new sixth edition from Wildy, Simmonds & Hill.

Over its more than 800 pages and fourteen chapters, it covers virtually every conceivable aspect of travel law, from accidents, to hotels and timeshares, to travel agents, to criminal offences and defences and more. Interestingly, in the light of recent events, there are several references to ‘denied boarding’ in the chapter concerning carriage of passengers and baggage which examines the ‘Denied Boarding Regulation’ in some detail.

The pivotal chapter is Chapter 1 on regulated package contracts. The Package Travel Regulation 1992 implemented in the UK as the Package Travel Directive, aims basically at protecting consumers and guaranteeing standards on package travel, holidays and tours.

Since the fifth edition of Saggerson’s was published in 2013 there has emerged a new Package Travel Directive 2015/2302 of the European Commission on package travel and linked arrangements. This means that if you are a travel lawyer, you need this book.

Be warned by the three expert editors of this new edition that ‘the law in this field never stands still’ especially so following the advent of Brexit and the possible, probable and ‘unknowable’ repercussions which are discussed in the editors’ preface and in the Foreword by Alan Saggerson himself. The legal implications relating to the practice of travel law, he says, ‘are likely to emerge in the manner in which English law famously excels -- slowly and carefully,’

‘I confidently predict,’ he adds, that… ‘the array of consumer protections born of the European Commission over the last 40 years will remain in place for a long time to come….’ Not much will soon change. Relax.’

Undeniably, this is a fascinating area of law on which this book offers a thorough and lucid examination. Easy to navigate, it provides extensive footnoted references plus tables of cases, statutes, statutory instruments, European legislation, international conventions, codes of conduct, guidance etc. and also of national legislation. As just about everyone travels these days, every lawyer should acquire a copy of this latest edition of Saggerson.

The law is stated as at 29th September 2016 and the book was published in 2017.
